Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of plananything.ai’s websites, applications, and services (the “Services”), provided by Bobos Studios LLC (“plananything.ai”, “we”, “our”, or “us”).

By accessing or using the Services, you agree to be bound by these Terms and all referenced policies. If you do not agree, you must not use the Services.

If you use the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization. References to “you” in these Terms refer to that organization where applicable.

2. Eligibility and Accounts

You must be at least 16 years old to use the Services. Use of the Services by individuals under 16 is not permitted.

You agree to provide accurate and complete information, safeguard your account credentials, and notify us promptly of any unauthorized access or security breach. You are responsible for all activity that occurs under your account.

One individual may own and manage multiple accounts. The account owner controls billing, subscriptions, and access permissions.

Project collaborators are responsible for their own edits, actions, and contributions within shared projects. Any internal disputes regarding permissions, approvals, authority, or responsibility are solely the responsibility of the users or their organizations and are not the responsibility of plananything.ai.

3. Subscriptions, Billing, and Payments

Paid subscriptions are billed in advance using the payment method on file. You authorize plananything.ai to charge applicable fees, taxes, and any approved add-ons or upgrades.

Payments are processed by Stripe. We support multiple currencies where available. Prices exclude applicable taxes unless explicitly stated otherwise, and you are responsible for any taxes, duties, or levies imposed by your jurisdiction.

If a payment fails, we may retry payment attempts for up to 7 days. During this grace period, access to paid features may be limited or suspended. Continued failure may result in suspension or termination of paid access.

Prices may change from time to time. Any price changes will be communicated with reasonable advance notice, will not apply retroactively, and will take effect only at the next renewal or billing period. Price changes do not affect fees already paid for the current billing period.

Downgrades do not result in prorated refunds.

4. Automatic Renewal

Subscriptions do not auto-renew by default. Auto-renewal must be explicitly enabled by you.

If auto-renewal is enabled, your subscription will renew at the end of the billing period at the then-current price, provided a valid payment method is on file. You may enable or disable auto-renewal at any time, effective for future billing periods.

plananything.ai provides reasonable advance notice of subscription renewal or expiration via email and/or in-app messaging.

We do not renew subscriptions without explicit user authorization.

5. Satisfaction Guarantee and Refunds

plananything.ai provides a thirty (30) day satisfaction guarantee (“Satisfaction Guarantee”) for customers purchasing a plananything.ai subscription for the first time or upgrading an existing subscription.

If you are not satisfied with your initial purchase for any reason, you may contact plananything.ai support within thirty (30) days of the purchase date to request a full refund. Refund eligibility is determined based on the date the refund request is received, not the date the refund is processed.

If you upgrade your subscription plan or purchase additional features (each, an “Upgrade”), the Satisfaction Guarantee applies for thirty (30) days from the date of the Upgrade. If a refund is requested during this period, your account will be reverted to the prior plan and plananything.ai will refund only the price difference between the prior plan and the Upgrade.

The Satisfaction Guarantee does not apply to:

• Enterprise, academic, custom-priced, or discounted plans

• Purchases made under sales-assisted agreements or contracts

• Renewals of previously purchased subscriptions

After the thirty (30) day Satisfaction Guarantee period, all purchases are non-refundable. You may cancel your subscription at any time, and access will continue until the end of the current paid billing period.

plananything.ai reserves the right to deny refund requests or revoke refund privileges on an individual basis in cases of suspected abuse of this policy or violations of these Terms.

6. Acceptable Use

You agree not to:

• Use the Services for unlawful or unauthorized purposes

• Interfere with or disrupt the Services or infrastructure

• Scrape, crawl, reverse engineer, or systematically extract data

• Introduce malware, automated abuse, or excessive load

• Misrepresent affiliation or access accounts without authorization

• Use the Services to intentionally benchmark, reverse engineer, or develop a competing product using confidential or non-public aspects of the Services

We may investigate suspected violations and take any action we deem appropriate, including content removal, access restrictions, or account suspension or termination, with or without prior notice.

7. Customer Content and Data

You retain ownership of all content you create or upload to the Services (“Customer Content”).

You grant plananything.ai a limited, non-exclusive license to host, process, store, and display Customer Content solely to provide, operate, and improve the Services.

Upon cancellation or termination, your data will be retained for 90 days, during which you may export it. After this retention period, data may be permanently deleted and may not be recoverable.

You are responsible for maintaining backups of your data.

We do not guarantee the preservation, availability, or integrity of Customer Content.

8. Privacy and Data Protection

Your use of the Services is also governed by our Privacy Policy, which forms part of these Terms and explains how we collect, use, and process personal data.

Where plananything.ai processes personal data on your behalf in connection with your use of the Services, you act as the data controller and plananything.ai acts as a data processor. We process such data only to provide and operate the Services, in accordance with our Privacy Policy and applicable data protection laws.

Where required by law, a data processing addendum (DPA) may be made available upon request.

You acknowledge that data may be processed and stored in jurisdictions outside your country of residence, including through third-party service providers such as hosting and payment processors.

9. AI-Generated Plans and Outputs

plananything.ai may generate timelines, plans, estimates, or suggestions using AI based on information provided by you and commonly used planning structures and assumptions.

AI-generated outputs are intended to assist with planning and organization by providing a structured starting point only. While plananything.ai aims to generate outputs that reasonably reflect your inputs, AI-generated content may be incomplete, inaccurate, or unsuitable for your specific use case, including omissions of tasks, dependencies, costs, timelines, or risks.

You are solely responsible for reviewing, validating, modifying, and approving all AI-generated outputs before relying on them for execution, budgeting, decision-making, or sharing with third parties. AI features do not replace professional, financial, operational, or project management judgment, domain expertise, or independent review.

The Services and any AI-generated outputs do not constitute legal, financial, accounting, or professional advice and must not be relied upon as such.

plananything.ai does not guarantee the completeness, accuracy, reliability, or suitability of AI-generated outputs for any particular purpose and is not responsible for errors, omissions, or outcomes resulting from reliance on such outputs.

AI features may be modified, expanded, limited, or removed at any time. Certain features may be designated as beta or experimental and are provided without warranties and may be changed or discontinued at any time.

10. Intellectual Property

plananything.ai retains all rights, title, and interest in the Services, including software, designs, templates, branding, and proprietary technology.

Subject to these Terms, plananything.ai grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your internal business or personal planning purposes.

You may not copy, resell, sublicense, or exploit any part of the Services except as expressly permitted.

Any feedback you provide may be used by plananything.ai without restriction or compensation.

11. Service Availability and Changes

The Services are provided “as-is” and “as available.” No service level agreement (SLA) applies unless expressly agreed in writing.

We do not guarantee uninterrupted, error-free, or continuous availability.

We may modify, suspend, or discontinue any part of the Services, features, or plans at any time, with or without notice, where reasonably necessary for operational, legal, or security reasons.

Maintenance, updates, outages, or third-party failures may occur.

While we take reasonable measures to protect the security and integrity of the Services, we do not guarantee that the Services or Customer Content will be free from unauthorized access, loss, corruption, or alteration, and we do not represent or warrant compliance with any specific security standards, frameworks, or certifications (including ISO, SOC, or similar), unless expressly agreed in writing.

plananything.ai is not responsible for loss of data, access interruptions, or damage resulting from security incidents, cyberattacks, or unauthorized access beyond our reasonable control.

Support availability and response times vary by plan. Free plans do not include guaranteed support. Any support provided to users on free plans is offered at plananything.ai’s discretion and may be limited, delayed, or discontinued at any time. Paid plans may include support features as described at the time of purchase or on the plananything.ai website. Support channels, availability, and response times may change over time.

12. Termination

You may cancel your subscription at any time.

We may suspend or terminate accounts for non-payment, violations of these Terms, abuse, fraud, or legal or security risks.

Upon termination or cancellation, access to paid features ends at the conclusion of the paid billing period, subject to data retention rules.

Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, governing law, dispute resolution, and data retention survive termination.

13. Disclaimers

To the maximum extent permitted by law, the Services are provided without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

14. Limitation of Liability

To the maximum extent permitted by law, plananything.ai’s total liability for any claim arising out of or relating to the Services will not exceed the fees paid by you in the 12 months preceding the claim.

plananything.ai shall not be liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits, revenue, business, or data.

Each party acknowledges that monetary damages are generally an adequate remedy for disputes arising out of or relating to the Services. However, nothing in these Terms shall prevent either party from seeking injunctive or equitable relief where such relief is necessary to prevent irreparable harm, including in cases of intellectual property infringement, misuse of proprietary technology, or unauthorized access to or use of the Services.

15. Indemnification

You agree to indemnify and hold harmless plananything.ai, its affiliates, officers, and employees from any claims, damages, losses, or expenses arising from:

• Your use of the Services

• Your Customer Content

• Your violation of these Terms or applicable law

This indemnity does not apply to claims arising from plananything.ai’s willful misconduct or gross negligence.

16. Force Majeure

plananything.ai is not liable for delays or failures caused by events beyond our reasonable control, including acts of God, natural disasters, internet or infrastructure failures, payment processor outages, government actions, or regulatory changes.

17. Export and Sanctions Compliance

You represent that your use of the Services complies with applicable export control, sanctions, and trade laws and regulations. You may not use the Services if you are located in a jurisdiction subject to comprehensive sanctions or otherwise prohibited by applicable law.

18. Assignment

We may assign or transfer these Terms, in whole or in part, as part of a merger, acquisition, corporate restructuring, or sale of assets. You may not assign these Terms without our prior written consent.

19. Governing Law and Arbitration

These Terms are governed by the laws of the United Arab Emirates.

Any dispute, controversy, or claim arising out of or relating to these Terms or the Services, including their validity, interpretation, performance, or termination, shall be finally resolved by arbitration.

The arbitration shall be conducted under the rules of the Dubai International Arbitration Centre (DIAC), by a single arbitrator, in English. These Terms are drafted in the English language, which shall be the governing language for all purposes of interpretation. The seat of arbitration shall be Dubai, United Arab Emirates.

The parties waive any right to bring claims as a class action, collective action, or representative proceeding. Arbitration shall be conducted on an individual basis only.

The arbitral award shall be final and binding on the parties and enforceable in any court of competent jurisdiction.

20. Changes to Terms

We may update these Terms from time to time. Continued use of the Services after updates constitutes acceptance of the revised Terms.

22. Entire Agreement

These Terms constitute the entire agreement between you and plananything.ai regarding the Services and supersede all prior or contemporaneous agreements, communications, representations, or understandings, whether written or oral, relating to the Services.
